Over the last decade, environmental, social and governance (ESG) risks have become inescapably important for natural resource and energy companies. A confluence of regulation, litigation, investor pressure, and stakeholder campaigns is driving a new generation of corporate governance. Social risks –the “S” in ESG – are arguably the most difficult to navigate because of their inherent uncertainty and the breadth of emerging expectations. Human rights are the analytical infrastructure of this intensifying risk environment and the lens through which the “S” has become law.

This special institute, only the second of its kind, will bring together leading experts from resource companies, external advisors, academia, government, and civil society to address the practical implications of trends in corporate human rights risk. The structure will be singularly focused on applied insight. Panels will canvas the most challenging emerging issues – from mandatory due diligence legislation and trade sanctions to investor-treaty disputes, the environment-human rights overlap, Indigenous rights, and the just transition. We will also explore the practical contours of these issues in the context of a real-world case study to aid in-house counsel and practitioners in implementing efficient and resilient strategy.

 This will be an invaluable opportunity for in-house counsel, practitioners, and stakeholders to learn how to navigate a fast-evolving and increasingly critical legal arena for all natural resource and energy companies.
