Over 50 years since its passage, the National Environmental Policy Act (NEPA) remains one of the most important centerpieces of U.S. environmental law and federal agency decision making. The intent of NEPA, rooted in aspirations of harmony between a person and their environment, has evolved over a half a century resulting in an expanded environmental review process simultaneously lauded and condemned, but undoubtedly complex. For natural resource and environmental law practitioners, a working understanding of NEPA’s requirements and nuances has never been more critical. In addition to a basic overview of NEPA, this program will explore advanced topics in NEPA procedures and policy, including the 2020 Council on Environmental Quality regulations and proposed revisions by the Biden Administration.
