The U.S. Environmental Protection Agency issued a memo on "COVID-19 Implications for Enforcement and Compliance Assurance" on March 26, 2020. With a number of important exceptions, the memo announces that enforcement discretion may be exercised for environmental compliance shortcomings arising from COVID-19. A number of state agencies have also issued enforcement guidance and adopted a variety of policies to address compliance challenges during this time. This webinar will critically examine the EPA memo and some of the other memos and policies issued to date and the pros and cons of these memos and policies from a variety of different perspectives.
