This Institute will address each step of litigating an energy, natural resources, or environmental case—from service of the complaint through trial—working through selection of counsel, joint-defense agreements, the discovery process, selection of and managing expert witnesses, preparing for trial, using jury consultants, and overall trial strategy. Rather than the Foundation’s Special Institutes’ typical focus on unique aspects of a particular area of law such as NEPA or the ESA or on an emerging natural resource issue, this program is devoted to the practicalities and unique aspects of litigating an energy, natural resources, or environmental case. Speakers will discuss different fact patterns from their respective experience to make each presentation “real world” relevant.

The Institute will benefit practitioners, in-house counsel, and government officials who find their client, company, or agency either defending a lawsuit or contemplating litigation, defending or pursuing counterclaims and crossclaims, or managing the process from case initiation through trial. Attendees will come away better prepared to handle the unique issues that arise when litigating an energy, natural resources, or environmental claim.
