The Permian Basin in West Texas and Eastern New Mexico is by far the largest U.S. shale oil basin, with production reaching a record 5.329 thousand barrels a day in August 2022, accounting for roughly 60% of domestic onshore oil production and adding an additional 21% of domestic onshore natural gas production. Many oil and gas companies have consolidated operations in the Permian for good reason—the average break-even price for most Permian well locations is below $50 a barrel, the lowest in the U.S. Nevertheless, legal challenges remain for companies operating in the Permian and their lawyers, landmen, and other advisors.

This new Special Institute, the first partnership between The Foundation for Natural Resources and Energy Law and the Texas Bar Association Section of Oil, Gas and Energy Resources Law, and co-sponsored by the New Mexico Bar Association Natural Resources, Energy, and Environmental Law Section, will examine essential legal concepts for lawyers, landmen, consultants, and others who operate or practice in the Permian Basin. Topics will include a keynote overview of the state and future of the Permian, legal differences between development and operations in Texas and New Mexico, challenges related to flaring and venting in the region, case law and litigation updates, important and evolving oil and gas royalty issues, lease expiration and termination, surface access and damages issues, developing federal and state minerals, midstream, water management, ethics, and more.
